Webdock Terms and Conditions

Effective date for new agreements: October 1st 2026.

1. Who we are and how these terms apply

Webdock.io ApS (“Webdock”, “we”, “us”) provides cloud hosting and related services subject to these terms and the service specifications and prices agreed when you order.

Our company details are:

“You” means the customer ordering or using our services. If you act for a business or other organisation, you must have authority to bind it. A “consumer” is a person acting mainly outside their trade, business or profession. A “business customer” is a customer acting in a business or professional capacity.

You must be of legal age to enter a binding agreement. You must accept the applicable terms when ordering. Your order and its confirmation identify the services, charges and billing interval. Individually agreed written terms take precedence where they expressly differ from these terms.

Nothing in these terms excludes rights or remedies that cannot lawfully be excluded. In particular, provisions concerning refunds, credits, cancellation, forfeiture, liability and claims are subject to mandatory consumer and payment laws.

2. No bullshit uptime guarantees — 99.9% is not enough

0.1% downtime is about 525 minutes a year. That is almost nine hours. We think that is too much.

We aim for no downtime within our control, including our hardware and network infrastructure. Downtime can nevertheless occur because of hardware failure, network problems or human error.

We will do our best to:

  1. Keep our hardware and network infrastructure available without interruption.
  2. Inform affected customers as soon as we become aware of a problem.
  3. Give timely notice of planned downtime.

If your server experiences unplanned service downtime in a calendar month, you may request compensation equivalent to one month of the affected service. Contact support and identify the affected server and incident. Compensation is provided only on request, as account credit for future Webdock services, rather than as a payment-method refund.

The credit is based on the affected service’s recurring subscription charge, taking account of applicable subscription discounts. For annual billing, one month is one-twelfth of the annual subscription charge; other billing intervals are converted to their monthly equivalent. Relevant taxes are adjusted as appropriate. Multiple interruptions affecting the same service in the same calendar month qualify for one monthly credit, rather than separate monthly credits for each interruption.

For this commitment, downtime means an interruption in the availability of the hosting service we provide. It does not include your own shutdown of a server, faults solely in software or configuration you control, or a suspension properly imposed under these terms. This credit commitment does not restrict mandatory statutory remedies.

If availability is critical to your business, you should design your application and infrastructure with appropriate redundancy and recovery arrangements.

3. How we deal with downtime

Hardware failures

When a host fails, our response normally includes alerting an engineer, identifying and replacing failed hardware, and restoring affected services. We aim to alert an engineer within 5–10 minutes. Hardware replacement typically takes 10–45 minutes, depending on the fault. Where restoration from backup is necessary, our normal recovery process uses the latest available backup, normally no more than 24 hours old, and aims to complete restoration within 60 minutes.

These are operational estimates, not guaranteed maximum recovery times. The original failure, the amount of data and the availability of usable backups can affect recovery. An overall interruption of approximately 20–120 minutes is an estimate for a typical hardware recovery, not a promise for every incident.

We will communicate information about affected services through the control panel and/or email as it becomes available. The compensation provision above applies to qualifying unplanned downtime.

Network incidents

Network incidents may arise within a datacenter or in third-party networks. They may affect particular geographical locations or routes rather than all customers. We will investigate incidents affecting our services and inform affected customers as appropriate.

4. Account creation and security

Provide accurate and current identification, contact and billing information, and keep it updated. We may request information reasonably needed to verify your identity, authority, payment or compliance with these terms.

Multiple accounts are not permitted without our approval. If you have a legitimate business need for multiple accounts, contact support first. Creating accounts to evade quotas, restrictions, suspensions or promotional limits is prohibited.

You are responsible for safeguarding your login credentials and for the activities of people you authorise to use your account. Notify us promptly of suspected unauthorised access or any security breach. Your responsibility for unauthorised activity is subject to applicable law; this provision does not remove our responsibility for failures for which we are legally liable.

Free development services may be available to eligible high-volume business customers by individual agreement. There is no general entitlement to three months of free service on newly provisioned servers.

5. Prohibited usage

Webdock is intended for legitimate websites, applications and related business workloads. You must comply with applicable law and must not use our services to harm Webdock, other customers or third parties.

The following are prohibited unless we have expressly approved a particular activity in writing where it can lawfully be approved:

  • Cryptocurrency mining and crypto, blockchain or testnet workloads.
  • Running neural networks or neural-network training workloads.
  • Stress-testing tools and network scanning.
  • Tor relay nodes and torrent seeding or downloading.
  • Media streaming configurations that misuse resources, and any unlawful streaming or distribution of copyrighted material.
  • Continuous high-load scraping of third-party websites and scraping that infringes copyright or other rights.
  • Traffic exchanges.
  • Intentional misuse of CPU, memory, storage, disk I/O or bandwidth, including sustained heavy workloads outside the intended use of the service or which materially impair other customers.

Ordinary legitimate hosting activity, such as serving websites, synchronising authorised data feeds, using APIs and running maintenance jobs, is not prohibited merely because it uses resources. Where high usage appears legitimate, we will ordinarily discuss it with you and may recommend a more suitable service. We may act immediately where necessary to protect the platform.

You must not:

  • Send spam or unsolicited bulk email, including substantially similar unsolicited messages to multiple recipients, forged-header messages or messages sent through compromised relays. This includes campaigns sent elsewhere that implicate our services or network.
  • Attempt unauthorised access, hacking, credential theft, phishing, malware distribution, denial-of-service attacks or circumvention of security controls.
  • Host, distribute or facilitate illegal content, infringement of intellectual-property rights, terrorist content, unlawful threats or other unlawful activity.
  • Host or disseminate content promoting terrorism, crime or violence, or depicting illegal acts in a manner that facilitates or encourages harm.
  • Supply false identity or contractual information, use fraudulent or unauthorised payment details, or misrepresent your authority to use an account or payment method.
  • Interfere with our services, infrastructure or other customers, or evade an enforcement measure through another account or intermediary.

You are responsible for the content you place on our services and for your authorised users’ conduct. Valid abuse complaints must be addressed promptly. A complaint does not have to result in a court judgment before we can take protective action based on reasonable evidence.

We do not routinely inspect all customer content. We may review relevant activity during onboarding and investigate unusual activity, suspected abuse or security incidents, subject to applicable law and our Privacy Policy.

Where a breach involves misuse of bandwidth, we may charge for bandwidth consumed in connection with that breach at the applicable published overage rates disclosed for the service, to the extent legally permitted. We may also pursue legally recoverable losses and remedies. We will not impose an undisclosed arbitrary penalty.

6. Support boundaries and server management

We provide support through our support-ticket system and limited telephone support during the hours stated on our support page. Support covers the functioning of the Webdock virtual server and platform. Except where specifically included in your service, it does not cover administration or troubleshooting of your applications, custom code, mail services or other third-party software. Our base LAMP and LEMP stacks are supported within the scope described in our documentation. We do not provide support directly to your customers.

For KVM VPS instances, you must keep the incus-agent software installed and running. Disabling or removing it prevents important platform functions from working and may prevent us from providing support. Failure to restore it after a request may result in suspension or termination of the affected service.

See https://docs.webdock.io/webdock-control-panel/recommendations-and-guidelines/why-we-require-the-incus-agent-in-kvm-vps.

You are responsible for your applications, configuration and appropriate independent copies of important data. Any backup features included with your service are described in the service documentation. They do not remove the need to plan for data recovery.

7. Subscriptions, invoicing and payment

Services are supplied on recurring subscriptions, ordinarily monthly or yearly, or at another interval expressly agreed when ordering. The price, billing interval, currency and applicable taxes are disclosed before you purchase. Fixed subscription charges are payable in advance. Any separately agreed usage-based charges or additional services are billed as disclosed when ordered. Invoices are due when issued unless a different due date is expressly stated.

Subscriptions renew automatically for successive agreed billing periods until cancelled. You can view billing information and manage available subscription options through your Webdock account and the billing interfaces we make available.

We use Stripe Billing to administer subscriptions, invoices and payments. Webdock remains your service provider and contractual counterparty. Available payment methods are shown at checkout and may include cards and PayPal.

By subscribing and completing the applicable payment authorisation, you authorise recurring charges through your selected payment method for the agreed subscription and any additional charges you authorise. Eligible account credits are applied before collecting the remaining amount. Your payment provider may require further authentication.

You must keep valid payment details and accurate billing information on your account. Failed payments may be retried automatically. Removing a payment method or revoking a payment authorisation does not, by itself, cancel a service or extinguish charges properly incurred. This does not restrict your statutory right to revoke a payment authorisation.

Your bank or payment provider may apply its own currency-conversion rates or charges. We are not responsible for charges independently imposed by your provider, except where applicable law makes us responsible.

Powering off a server or choosing not to use it does not cancel its subscription or stop billing: resources remain allocated until the service ends.

8. Upgrades and downgrades

When an upgrade or downgrade takes effect during a billing period, we credit the unused portion of the old plan and charge for the new plan for the remaining portion of that billing period. The existing renewal date stays the same unless a different arrangement is expressly shown and agreed.

Adjustments take account of the applicable plan prices, discounts and taxes. Any credit from the adjustment is applied to your Webdock account; it is not returned to the original payment method. Any remaining amount due is collected through billing. The applicable charge or credit is shown when arranging the change or in the resulting billing documentation.

A credit is not due for a period that was never paid for. Amounts attributable to promotional credit retain their promotional character. These rules do not restrict mandatory rights to a monetary reimbursement.

9. Account credits and top-ups

Account credits can be used to pay for eligible Webdock services. Credit may arise from purchased top-ups, legacy Service Credits, billing adjustments, promotions or downtime compensation.

Purchased top-ups are non-refundable under our ordinary commercial policy, regardless of the payment method used, and do not expire. Legacy Service Credit balances were carried over into the Stripe-managed account balance without a reduction in their value or a change to their paid or promotional nature.

Promotional credits can be used only for eligible Webdock services and cannot be redeemed for money. Any promotion-specific eligibility or expiry conditions must be disclosed when the credit is offered. Eligible promotional credits are used before paid credits.

Billing adjustments and any goodwill credit we choose to grant are credited to the account rather than returned to a card, PayPal account or other payment method. There is no entitlement to a discretionary refund or goodwill credit. Monetary reimbursement is available only where expressly provided in these terms, separately agreed by us, or required by applicable law.

Downtime compensation is provided as described in section 2. It does not itself cancel or extend a subscription; the credit reduces future service charges.

These restrictions do not remove any mandatory right to redeem a paid balance, withdraw from a purchase, or obtain repayment under applicable consumer or payment law. Where such a right applies, we will process the payment required by law rather than require you to accept account credit.

10. Cancelling a subscription

Who qualifies for cancellation, credits and refunds

Our standard policy applies to all customers, including business customers and consumers in any country: you may stop renewal, but the subscription continues until the end of the paid billing period. We do not offer a voluntary cooling-off period, money-back guarantee or change-of-mind refund. Except for the express contractual remedies identified below, early termination, redemption of paid balances and monetary refunds are available only to the extent required by the law applicable to the particular agreement and claim.

Request or event Who qualifies Standard outcome
Stop the next renewal All customers Service continues to the paid-period end; no cancellation fee, refund or unused-time credit.
Upgrade or downgrade Customers making an eligible plan change Prorated account adjustment under section 8; no payment-method refund.
Unplanned downtime Customers meeting section 2 who request compensation Account credit equivalent to one month of the affected service.
Cash out a purchased top-up or paid balance No voluntary redemption entitlement No payout unless applicable law requires it.
Cash out free promotional credit No voluntary cash entitlement Credit is usable only for eligible services; mandatory law remains unaffected.
Withdraw during a statutory cooling-off period Consumers whose particular purchase is covered by an applicable statutory withdrawal right Section 11 and the applicable legal conditions determine the deadline, deduction and reimbursement.
End a prepaid term early under consumer subscription law Consumers whose agreement is covered by that mandatory right Section 10 below and applicable law determine the end date and any repayment.
Webdock ends paid service early without customer breach Customers covered by section 14 Reimbursement for the prepaid service period we will not supply.
Customer rejects a materially adverse change Customers covered by section 17 Termination before the change and the unused-prepayment reimbursement provided there.
Defective service, incorrect or unauthorised charge, or another legally protected claim Customers entitled to a remedy under applicable law The remedy required by that law; the standard no-refund policy does not override it.

Consumer withdrawal and statutory consumer cancellation rights do not apply to purchases made in a business or professional capacity. Such purchasers retain the ordinary cancellation and express contractual remedies above and any other mandatory rights that apply to them.

For consumers, eligibility is determined by the law applicable to the agreement, the purpose and circumstances of the purchase, and the conditions of the particular statutory right. Consumer purchases covered by Danish or other applicable EU/EEA withdrawal rules qualify under those rules. Consumers elsewhere qualify only where applicable law grants the relevant right; these terms do not voluntarily extend the EU/EEA withdrawal regime worldwide. Residence or nationality alone is not conclusive, and the Danish-law clause must be taken into account when determining applicable rights. This section does not exclude protections required by another applicable jurisdiction.

Calling an account “personal” or “business”, supplying a VAT number, or choosing a particular payment method does not by itself conclusively determine consumer status. A reference in these terms to statutory rights explains and preserves those rights; it does not create a matching contractual entitlement for customers or transactions outside their legal scope.

Ordinary cancellation

You can cancel renewal through the cancellation controls made available in your Webdock account. If you have difficulty doing so, contact support. We will not disregard a legally effective cancellation merely because it was submitted through another legally permitted channel.

Ordinary cancellation takes effect at the end of the current paid billing period. Your service remains available until then, subject to these terms, and will not renew afterward. The account interface or cancellation confirmation identifies the scheduled end date.

There is no customer option to delete a server immediately instead of waiting for the scheduled service end. Ordinary cancellation does not generate a refund or credit for the remaining billing period. We do not charge a cancellation fee.

When the service ends, it is shut down and the server and associated data are scheduled for deletion automatically. Export anything you need before the end date. You must not rely on continued access or recovery after that date.

Cancellation does not remove responsibility for charges properly accrued before the service ends. Any final usage or other previously authorised charges remain payable.

The automatic shutdown and deletion following your scheduled cancellation is separate from our human-review policy for deletion due to missed payments.

Mandatory consumer cancellation rights

Where Danish statutory rules for ongoing consumer subscriptions apply, you may also terminate after five months with one month’s notice to the end of a calendar month, subject to the applicable statutory exceptions. A longer prepaid billing interval does not remove that right. If a mandatory right ends your contract earlier than the paid-through date, we will reimburse the amount legally due for the subsequent period. Contact support to exercise this right. Any shorter cancellation right under these terms remains available.

11. Statutory consumer withdrawal — eligible purchases only

This section applies only where you are acting as a consumer and the law applicable to your particular purchase grants a statutory withdrawal right. It does not grant business customers a cooling-off right, and does not create a voluntary worldwide refund or withdrawal policy. If no statutory withdrawal right applies, ordinary cancellation under section 10 is available, but changing your mind does not entitle you to terminate early or receive a refund or credit.

For an eligible online service purchase under the Danish/EU withdrawal regime, the ordinary withdrawal period is 14 days from entering the agreement. Statutory extensions apply where required information has not been provided. Where another applicable law grants a different mandatory right, its conditions and deadlines apply instead. This is separate from ordinary subscription cancellation.

An automatic renewal or recurring payment under the same continuing agreement does not, by itself, create a new voluntary withdrawal period. Where applicable law gives a withdrawal right for a renewal, new agreement or material change, that right remains available.

To exercise an applicable withdrawal right, send an unambiguous statement to [email protected] or our postal address in section 1 before the deadline. Identify the service or order so that we can locate the agreement. You may use the optional form below, but it is not compulsory, and no legal citation or particular wording is required. Any legally required online withdrawal facility is an additional way to submit the request. We also accept any other method that applicable law requires us to accept.

If you expressly request that service begin during the withdrawal period, and we have provided the required information, you must pay the lawful proportionate amount for service supplied up to your withdrawal. Activation alone does not remove your withdrawal right for an ongoing hosting service.

For a valid withdrawal under the Danish/EU regime described above, we reimburse the amount legally due without undue delay and within 14 days of receiving notice, normally through the original payment method. A different method requires your express agreement and must not cause you fees. Where another mandatory regime applies, we follow its reimbursement requirements. These statutory reimbursements are not restricted to account credit. Submitting a request does not itself establish eligibility, but a valid right does not depend on discretionary approval by Webdock.

12. Closing your account and personal information

Account closure is separate from cancelling a subscription. Cancel your active subscriptions and allow the services to end before closing the account using the account-deletion control. Contact support if you need help. Account closure does not cancel outstanding charges that were properly incurred.

Before you confirm account deletion, we warn you that any remaining account credit will be forfeited. If you proceed, you give up that remaining balance under our ordinary account-closure policy, except to the extent that a mandatory legal right prevents forfeiture. Contact support before deletion if you want to raise a repayment or redemption claim.

We do not routinely delete customer accounts with positive balances on our own initiative. This does not prevent us from suspending or terminating services for abuse, fraud, security reasons or other grounds stated in these terms. Any balance is handled subject to applicable law.

Following account deletion, we delete personal information that is no longer needed. We retain accounting records and associated transaction information for the periods required by law. Where applicable law requires preservation of other records, including a binding preservation requirement, that requirement also applies. Retained information is used only for lawful retention purposes and is deleted when retention is no longer required. Further details are in our Privacy Policy.

13. Missed payments

An account that reaches 10 days past due may have services suspended. We may send reminders and retry payment. You should update your payment details or complete any required authentication promptly.

If payment is severely overdue, affected servers may be flagged for deletion. We do not automatically delete servers solely because of missed payments. A person reviews the account first, taking account of the customer’s history and other relevant circumstances. We will make our best effort to contact you directly before deletion and to avoid accidental loss of your server.

This missed-payment review policy does not delay urgent action against abuse, fraud or security threats under section 14, or scheduled deletion following your cancellation.

Amounts properly owed remain payable after suspension or termination. We may refer unpaid debts to an external collection agency in accordance with applicable law. Collection fees or interest will be charged only where legally permitted and on the required basis.

14. Suspension and termination by Webdock

We may immediately restrict access, isolate a server, suspend services or terminate affected services or accounts where we reasonably determine that action is necessary because of:

  • A material or repeated breach of these terms.
  • Actual or reasonably suspected fraud, payment fraud, unlawful activity or materially false identification or account information.
  • Abuse, malware, spam, unauthorised access or activity threatening our infrastructure, staff, customers or third parties.
  • An attack targeting a service where protective action is reasonably necessary to protect the platform or other customers, even if the customer did not cause the attack.
  • Evasion of restrictions, account suspensions or verification requirements.
  • A legal obligation, binding order, applicable sanctions or a lawful requirement of a competent authority.

We may act on credible indicators and reasonable evidence without waiting for a criminal conviction or final court determination. Where linked accounts are reasonably implicated, protective measures may apply to those accounts too. We may suspend access while investigating.

We do not have to provide advance notice or an opportunity to remedy a breach where delay could increase harm, enable evasion, compromise an investigation or breach the law. Otherwise, we will give notice and an opportunity to resolve the issue where reasonable in the circumstances. We will explain the action as far as reasonably possible and legally permitted. You may contact support to request review or provide relevant information, but doing so does not require us to restore access while a risk remains.

Access to retrieve data may be restricted where necessary for security, protection of others, evidence preservation or compliance with law. We are not obliged to facilitate continued unlawful activity. Where safe and lawful, we will consider requests to retrieve legitimate customer data.

Where suspension or termination results from your material breach, unused subscription charges are not refundable under our ordinary policy, and no service credit is due for a justified suspension caused by your breach, subject to mandatory law. This does not automatically extinguish a legally protected right concerning purchased account credit.

We may also terminate a service without alleging fault by giving at least 30 days’ notice. If we end a paid service early without customer breach, we will reimburse prepaid charges for the period we will not supply. We will not force you to accept unusable account credit in place of that reimbursement. Accrued payment obligations and mandatory remedies remain unaffected.

15. Network addresses

IP addresses assigned to you remain under Webdock’s control and are provided only for use with the relevant service during its term. You do not acquire ownership of an address or an independent right to continue using it after the service ends.

Address allocation is subject to applicable registry policies and technical availability. Use name-based hosting where the protocol supports it; IP-based virtual hosts do not automatically justify additional addresses. We may make reasonably necessary address changes, giving notice where practicable.

16. Coupons and promotions

Promotions apply only to eligible Webdock services and on the conditions disclosed with the offer. Those conditions identify the discount or credit, eligibility, redemption period and duration. Unless the offer says otherwise, one redemption is permitted per customer and offers cannot be combined.

A discount must be validly applied to the eligible order. A discounted first period does not mean every renewal is discounted; the applicable duration and renewal price will be disclosed before purchase.

We may withdraw or amend an offer prospectively, but this does not retrospectively remove a discount already validly granted for its agreed duration. Fraudulent redemptions, multiple-account abuse and obvious misuse may be refused or reversed to the extent legally permitted.

Promotional value is not paid cash and cannot be converted into a monetary refund. Adjustments to a discounted purchase reflect the discount actually received. Applicable taxes are handled according to law and shown in billing.

17. Changes to prices and terms

We may make reasonable, proportionate changes where necessary to reflect changes in law or regulatory requirements; taxes or public charges; material changes in the costs of energy, datacenter operation, connectivity, hardware, software licensing or labour used to supply the service; or technical and security requirements affecting the service.

Any change must relate to its stated reason. This clause does not give us an unrestricted right to rewrite the essential nature of your agreement or remove accrued rights.

For materially adverse changes, we will send you direct notice by email at least 30 days before the proposed effective date, or longer where required by law or your agreement. The notice will explain what is changing, why, when it is proposed to take effect, and your cancellation options.

Price increases apply only to a renewal that begins after the notice period. We will not increase the agreed price retrospectively or reprice a billing period already paid for.

If you do not accept a materially adverse change, you may terminate the affected service before it takes effect without a cancellation fee. Where that ends an already-paid period early, we will reimburse the legally or contractually due unused amount. Mandatory statutory repayment rights are not limited to account credit.

A shorter notice period may be used only to the extent necessary and legally permitted to comply with law or address an urgent security threat. We will explain the reason and give as much notice as reasonably possible. Minor administrative corrections and changes solely benefiting customers may take effect earlier where permitted.

Where a change requires your express agreement, we will obtain it. Publication on our website or silence does not substitute for legally required consent.

18. Liability and warranties

We provide the services described in your order and these terms. We do not promise uninterrupted or error-free operation, or suitability for a particular purpose beyond an express commitment we have made. The uptime-credit commitment remains applicable as stated above.

We are not responsible for failures outside our reasonable control to the extent permitted by law. This does not excuse a failure for which applicable law makes us responsible.

For business customers, to the fullest extent legally permitted, we exclude liability for indirect or consequential loss, lost profit, lost revenue, lost business opportunities and loss or corruption of data. For other recoverable loss caused by our ordinary negligence, our aggregate liability is limited to the charges payable for the affected service during the period in which the loss occurred.

These exclusions and limits do not apply to fraud, wilful misconduct, gross negligence, death or personal injury for which we are liable, or any other liability that cannot legally be excluded or limited. They do not remove an express obligation to return prepaid charges or account funds under these terms or applicable law.

Consumers retain statutory rights concerning conformity, defective services and remedies. No “as is” description or warranty disclaimer overrides those rights.

19. Business-customer indemnity

If you are a business customer, you must indemnify us against third-party claims, damages and reasonable legal costs to the extent caused by your unlawful use of the services, your material breach of these terms, or unlawful content or conduct for which you are responsible.

We will notify you of a claim as reasonably practicable and cooperate reasonably in its defence. This obligation does not cover losses caused by our own breach, negligence or misconduct, and does not authorise unnecessary or unreasonable costs. Consumer liability is determined by applicable law rather than this business indemnity.

20. Law-enforcement requests and privacy

We may preserve or disclose account, transaction, network and other relevant information where required by law or a valid order, or where otherwise lawfully justified. We may notify you unless notification is prohibited or would prejudice a lawful investigation or protective action.

Our transparency information is available at https://docs.webdock.io/general-information/legal-stuff/transparency-report. Reporting is subject to legal restrictions and must not disclose information we are prohibited from publishing.

Our Privacy Policy describes how we handle personal information: https://docs.webdock.io/general-information/legal-stuff/privacy-policy-gdpr.

21. Notices, complaints and governing law

Keep your account email address current. We may send ordinary service notices through email or the control panel. Material adverse contractual changes are notified directly as described in section 17. Where the law requires information on a durable medium, we will provide it in that form.

Send complaints to [email protected]. Consumers may also use any applicable statutory complaint or dispute-resolution procedure; nothing here removes that entitlement.

These terms and our agreement are governed by Danish law. Applicable EU law continues to apply. For consumers, this choice does not remove mandatory protections afforded by the law that would otherwise apply to their agreement.

Disputes with business customers are subject to the exclusive jurisdiction of the competent Danish courts at Webdock’s registered office. Consumers retain any mandatory rights to bring or defend proceedings in other competent courts.

22. Time limits for claims

For business customers only, and only to the extent legally permitted, claims for damages arising from the services must be brought within one year after the customer knew or reasonably should have known of the claim and the party responsible. Any legally required interruption or suspension of that period applies.

This contractual limit does not apply to consumer claims, claims involving fraud, wilful misconduct or gross negligence, personal injury, repayment of customer funds, or any claim for which mandatory law prevents the limit. Those claims are subject to applicable statutory time limits.

23. Entire agreement, waiver and severability

Your order, any individually agreed written conditions and these terms form the agreement for the services. Any other policy forms part of the contract only where it was validly incorporated. These terms do not retrospectively replace terms governing earlier events or override mandatory pre-contractual information or rights.

A failure or delay in enforcing a right is not a waiver of that right. If a provision is invalid or unenforceable, it will not apply to that extent and the remaining provisions continue where legally possible. Mandatory legal rules apply in place of an invalid provision; this does not permit an invalid consumer term to be rewritten to the customer’s disadvantage.
